    LOWELL TOWN COUNCIL
    REGULAR MEETING
    DECEMBER 14, 2009



The regular meeting of the Lowell Town Council was called to order on Monday, December14, 2009 at 7:00 P.M. by President Phillip Kuiper.   The Pledge of Allegiance was recited and a moment of silence was observed. President Philip Kuiper called the roll.  Members present were Donald Huseman, John Alessia, Phillip Kuiper and David Gard. Clerk-Treasurer Judith Walters and  Councilman Tucker were absent.  Also present were Town Attorney Greg Sobkowski, Director of Public Works Greg Shook, Town Administrator Susan Peterson, Police Chief John Shelhart, three members of the media, and four interested citizens.  
                                    
APPROVAL OF MINUTES                            

Councilman Huseman made a motion to approve the minutes from the November 23rd regular meeting, seconded by Councilman Alessia.  The motion carried by voice vote.  

APPROVAL OF VOUCHERS

President Kuiper stated that he had reviewed White Vouchers #2579-2653, White Police Vouchers #4118-4127, Water Vouchers #2733-2773 and Waste Water Vouchers #3608-3636 and recommended them for approval.  Councilman Huseman made a motion to approve the vouchers as listed, seconded by Councilman Alessia.  The motion carried by voice vote.  

PETITIONS, COMMUNICATIONS, REMONSTRANCES, PROCLAMATIONS


MONTHLY REPORTS

Councilman Gard made a motion to accept the monthly reports from November, 2009 as presented, seconded by Councilman Alessia.  The motion carried by voice vote.
Councilman Huseman questioned the Cedar Lake’s wastewater flow as it has increased.

UNFINISHED BUSINESS


Public Works Department  - Greg Shook had information on a school zone flashing signal, Councilman Alessia asked if it would be installed in concrete, yes it would and the cost will be lower because it is solar powered..


Councilman David Gard talked with Terry Wright about the recent violation at the WWTP.  Terry felt it could have been avoided if the SCADA System was working across the internet.  It hasn’t been working since RTL Systems went out of business. The SCADA Systems works, it just does not work across the internet.  Greg Shook said he is hoping to get wireless service with Air Baud and then have Gigahertz come and try to get the SCADA working across the internet.

Councilman Huseman asked if a thank you letter had been mailed to Jack Kovich for the soccer fields at Freedom Park.  Greg Shook said he would check with the Parks Department.

Councilman Huseman also questioned the status of the Powell Ditch, feared being sued if something is not resolved.  The tiles have been given to Commonwealth.

New Business

President Kuiper would like to see the Redevelopment Commission reinstated.  Recommended members to be Phil Kuiper, John Alessia, Doug Niksch, Jim Langen and Brian Sanders.  Councilman Gard made a motion to approve the request, seconded by Councilman Alessia.  The motion carried by voice vote.

Renew two year contract with Greg Shook.  Councilman Alessia made a motion to approve the request seconded by Councilman Huseman.  The motion carried by voice vote.

President Kuiper asked that the town of Lowell  recognize Veteran’s Day as paid a holiday.  Councilman Huseman made a motion to recognize Veteran’s Day as a holiday for the Town of Lowell, seconded by Councilman Gard.  The motion carried by voice.

ANNOUNCEMENTS


President Kuiper gave kudos to the Parks Department for the Parade of Lights, it was the most entries we have ever had.

President Kuiper announced the next regular meeting will be held on Monday, December 28th at 7:00 P.M.


MEDIA QUESTIONS/PUBLIC COMMENTS

A member of the media questioned if she could get the names of the Redevelopment Commission.

Scott Pickering wanted to publicly say thank you to the Town Council for his mothers wheel chair ramp.

There being no further business or discussion, Councilman Gard made a motion to adjourn, seconded by Councilman Alessia at 7:13 P.M.
